Privacy Policy (V1.1)

1. About This Privacy Policy

1.1 This Privacy Policy describes how we collect, use, disclose, store, retain, and protect personal information in connection with the Platform and related services, including account registration, tutor listings, messaging, booking tools, and tutor subscription billing.

1.2 This Privacy Policy applies to personal information we handle when a person visits the Platform, creates or uses an Account, searches for tutors, communicates through Platform tools, arranges Bookings, purchases a tutor Subscription Plan, or contacts support.

1.3 This Privacy Policy forms part of the Agreement Suite referenced in the Terms of Use, and this Privacy Policy addresses personal information topics while the Terms of Use and user agreements address contractual terms for Platform use.

2. Privacy Law Framework

2.1 We operate in British Columbia and we handle personal information under a framework intended to comply with the Personal Information Protection Act of British Columbia, including obligations relating to access, correction, safeguards, and retention.

2.2 In the event that personal information is handled in connection with interprovincial or international commercial activity, additional privacy requirements can apply, including federal private sector privacy requirements that address access requests and related obligations in certain contexts.

3. Definitions

3.1 Personal information means information about an identifiable individual, and it does not include business contact information when used only for business contact purposes as permitted by applicable law.

3.2 Account has the meaning set out in the Terms of Use.

3.3 Tutor, Student, Guardian, Booking, and Content have the meanings set out in the Terms of Use.

3.4 Tutor Subscription Plan means the paid subscription tier selected by a Tutor that determines Plan Fees and Plan Features under the Tutor User Agreement.

4. Personal Information We Collect

4.1 Information you provide for an Account.

We collect personal information you provide when you create or update an Account, including name, email address, phone number, password or authentication credential, user role selection, and account preferences.

4.2 Information you provide for Student and Guardian use.

We collect personal information provided by a Student and a Guardian to support the Age of Majority framework and booking coordination, including Guardian identity and contact information, Student first name or profile name, and age-related information used to apply Guardian acceptance requirements

4.3 Information a Tutor provides for a Listing.

We collect personal information a Tutor submits for a Listing, including profile name, profile photo, subjects offered, service modality, availability, general service location, languages, education and qualifications information a Tutor chooses to display, and other Content a Tutor posts as part of a Listing.

4.4 Messages and communications.

We collect message content and related metadata when Users use Platform messaging tools, including message timestamps, sender and recipient identifiers, and message content, and we also collect communications sent to support channels.

4.5 Booking and scheduling information.

We collect booking related information created through Platform tools, including requested times, confirmed times, cancellations, booking notes, service modality, and identifiers that connect a Booking to relevant Accounts.

4.6 Tutor subscription and transaction information.

We collect Tutor Subscription Plan information, billing status, renewal and cancellation status, and transaction identifiers, and payment card details are handled by a third-party payment processor where the Platform uses tokenized processing and does not store full payment card numbers on Platform servers.

4.7 Support, reports, and complaints.

We collect personal information you provide when you request support, submit a report, or make a complaint, including the content of the request and information needed to verify identity and respond.

4.8 Device and log information.

We collect technical data associated with Platform access, including IP address, device type, operating system, browser type, pages viewed, approximate region based on IP address, timestamps, referral information, and identifiers used for security, fraud prevention, and system administration.

4.9 Cookies and similar technologies.

We use cookies and similar technologies for authentication, security, preferences, and analytics, and cookie settings can be managed through browser controls, and disabling certain cookies can reduce Platform functionality.

4.10 Information we receive from other Users.

We collect personal information that another User provides about you in connection with Platform use, including booking messages, support reports, complaints, or feedback, where the information is relevant to safety, integrity, dispute management, or Platform operations.

4.11 Information from third party services.

In the event that you sign in using a third-party authentication provider or connect a third-party service, we collect information received from that provider as required to enable sign in or connection, and the categories depend on the provider and the permissions you grant.

5. How We Use Personal Information

5.1 To provide the Platform.

We use personal information to create and manage Accounts, enable search and discovery, display Listings, facilitate messaging and booking tools, and provide Platform features

5.2 To operate Tutor Subscription Plans.

We use personal information to process Tutor Subscription Plan purchases, manage recurring billing status, apply Plan Features, process cancellations of auto renewal, and administer account access that depends on subscription status.

5.3 To communicate about the service.

We use personal information to send service-related messages necessary to operate the Platform, including confirmations, security notices, account notices, and support responses.

5.4 To enforce the Agreement Suite and protect integrity.

We use personal information to detect and prevent fraud, misuse, harassment, and security incidents, to investigate reports, and to enforce the Agreement Suite, including account restrictions and content moderation.

5.5 To improve and maintain the Platform.

We use personal information to troubleshoot issues, monitor performance, develop features, conduct analytics, and improve usability and safety.

5.6 To comply with law and legal process.

In the event that we receive lawful requests or legal process, we use personal information to comply with legal obligations and respond to court orders and authorized requests.

5.7 To protect rights and manage disputes.

We use personal information to establish, exercise, or defend legal claims, to manage disputes, and to protect the rights, safety, and security of Users and the Operator.

6. How We Disclose Personal Information

6.1 Disclosure to other Users through Platform functions.

We disclose personal information to other Users as part of Platform operation, including disclosure of Tutor Listing information to Students and Guardians, and disclosure of booking coordination information to a Tutor and a Student or Guardian involved in the Booking.

6.2 Disclosure to service providers.

We disclose personal information to service providers that perform services for the Platform, including hosting, database services, analytics, security monitoring, communications delivery, customer support tools, and payment processing, and service providers receive access only to the extent needed to perform services.

6.3 Disclosure to payment processors.

In the event that a Tutor purchases a Tutor Subscription Plan, we disclose transaction information needed to process payment and manage recurring billing to the payment processor, and the payment processor processes payment information under the terms between the Tutor and the payment processor.

6.4 Disclosure for legal compliance and safety.

In the event that disclosure is required by law, court order, or lawful process, we disclose personal information to law enforcement, regulators, courts, or other authorized parties as required.

6.5 Disclosure to protect Users and the Platform.

In the event that we reasonably believe disclosure is necessary to protect Users, prevent harm, investigate fraud, respond to a security incident, or enforce the Agreement Suite, we disclose personal information to the extent appropriate for those purposes, subject to applicable law

6.6 Disclosure in corporate transactions.

In the event of a merger, acquisition, reorganization, financing, or sale of assets, we disclose personal information as part of due diligence and transaction completion, subject to confidentiality protections and applicable law.

6.7 Disclosure based on consent.

In the event that you provide express consent for a specific disclosure, we disclose personal information consistent with that consent.

7. Consent, Marketing Communications, and Preferences

7.1 We collect, use, and disclose personal information with consent where required by applicable law, and consent can be express or implied depending on context and sensitivity.

7.2 Service related communications are used to operate the Platform and they include security notices, account notices, billing status notices for Tutors, and support communications.

7.3 In the event that we send marketing communications, we send marketing communications only where consent exists or where permitted by applicable law, and marketing communications include an unsubscribe mechanism consistent with Canadian anti spam requirements.

7.4 You can manage marketing preferences through account settings where available, through unsubscribe mechanisms in marketing messages, or by contacting the Privacy Contact.

8. Children and Minors

8.1 The Platform supports Student use, and the Student User Agreement requires Guardian acceptance for a Student who has not reached the Age of Majority in British Columbia.

8.2 In the event that we become aware that personal information has been collected or used in a manner inconsistent with Guardian acceptance requirements, we take steps intended to address the issue, including restricting access and requesting Guardian confirmation.

8.3 We limit collection and disclosure of minor related personal information to what is reasonably necessary for account operation, booking coordination, safety, and compliance purposes.

9. Cookies, Analytics, and Tracking Controls

9.1 Cookies and similar technologies support login sessions, security controls, fraud prevention, preference settings, and analytics used to understand Platform performance.

9.2 Analytics tools process usage signals such as page views, feature usage, and approximate location derived from IP address, and analytics results are used to improve Platform stability, usability, and safety.

9.3 You can control cookies through browser settings, and if you block or delete certain cookies, Platform features that depend on cookies, including login persistence and certain preferences, can stop working correct

10. Data Retention and Deletion

10.1 We retain personal information only as long as necessary for the purposes described in this Privacy Policy, including legal compliance, dispute management, fraud prevention, safety, and Platform integrity.

10.2 In the event that we use personal information to make a decision that directly affects an individual, we retain that information for at least one year after using it so the individual has a reasonable opportunity to request access.

10.3 In the event that the purposes for collection are no longer served and retention is no longer necessary for legal or business purposes, we destroy documents containing personal information or remove the means by which the information can be associated with particular individuals, consistent with applicable law.

10.4 Account closure results in deletion or de identification within a reasonable period, subject to retention needed for legal compliance, dispute management, fraud prevention, security incident response, and enforcement of the Agreement Suite.

10.5 Backups and logs can persist for limited periods due to system architecture and security requirements, and access to backups is restricted and controlled.

11. Transfers Outside Canada

11.1 We store and process personal information using systems operated by the Operator and service providers, and some systems can be located outside Canada.

11.2 In the event that personal information is stored or processed outside Canada, personal information can be subject to the laws of the jurisdiction where storage or processing occurs, including laws that permit government access under lawful process.

11.3 We use contractual and technical safeguards intended to protect personal information handled by service providers, including confidentiality commitments and access controls appropriate to the sensitivity of information.

12. Security Safeguards

12.1 We protect personal information in custody or under control of the Operator by making reasonable security arrangements to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks.

12.2 Security safeguards include access controls, least privilege permissions, monitoring, encryption in transit where supported, secure development practices, and incident response procedures.

12.3 No security program eliminates all risk, and you remain responsible for protecting login credentials and using secure devices and networks

13. Your Rights and Controls

13.1 Access requests.

You can request access to personal information under our control, and under British Columbia private sector privacy law an organization must respond to an access request within 30 days, subject to permitted extensions. (BC Laws)

13.2 Correction requests.

You can request correction of errors or omissions in personal information under our control, and correction obligations include correction and, in certain circumstances, distribution of corrected information to organizations to which the information was disclosed during the previous year. 13.3 Withdrawal of consent.

In the event that processing is based on consent and consent is withdrawn, we stop processing to the extent required, and continued Platform functionality can be limited where information is needed to provide services, prevent fraud, or comply with law.

13.4 Account tools.

Where account settings are available, account settings allow you to update certain personal information and preferences, and support can assist where account tools do not address a request.

13.5 How to submit requests.

Requests for access, correction, or other privacy requests should be submitted in writing to the Privacy Contact and include sufficient detail to verify identity and locate responsive information, consistent with written request requirements under British Columbia private sector privacy law. 13.6 Complaints to a regulator.

You can submit a complaint regarding handling of personal information to the Office of the Information and Privacy Commissioner for British Columbia.

14. Automated Processing and Profiling

14.1 We use automated tools to support security, fraud prevention, spam prevention, content moderation signals, and analytics, and these tools help identify suspicious activity and support Platform integrity.

14.2 We do not represent that automated processing is free from error, and review processes can involve human review depending on context, including in the event that account enforcement action is under consideration.

15. Third Party Links and Off Platform Activity

15.1 The Platform can include links to third party sites and Users can choose to communicate or transact off Platform, and third party privacy practices apply to those third party activities.

15.2 We are not responsible for privacy practices of third party sites or services, and you should review third party privacy notices when using third party services.

16. Changes to This Privacy Policy

16.1 We reserve the right, in the sole discretion of the Operator, to change, modify, amend, or otherwise alter this Privacy Policy at any time

16.2 Modifications become effective immediately upon posting on the Platform, unless the posting states a later effective date, or unless applicable law requires a different effective time or additional notice.

16.3 You review this Privacy Policy on a regular basis to remain informed of changes.

16.4 In the event that you continue to access or use the Platform after a change becomes effective, you accept the change, and in the event that you do not agree with a change, you stop using the Platform and you close the Account.

17.1 Questions, requests, and complaints relating to privacy should be sent to the Privacy Contact listed at the top of this Privacy Policy.

17.2 In the event that you contact us, you provide sufficient information to verify identity and enable a response, and we respond in accordance with applicable law, including access request response timeline
